These Terms and Conditions (“Terms”) govern your use of millercoachingservices.com (the “Website”), as well as any coaching services, digital products, consultations, or related offerings provided by the Company (collectively, the “Services”).

By accessing or using the Website or Services, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.

Terms & Conditions - The Basics

1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to access or use our Services. By using our Website or Services, you represent that you meet these requirements.

2. Coaching Services Disclaimer
Miller Coaching Services provides professional coaching, which is not therapy, counseling, legal advice, financial advice, mental health services, or medical treatment.

By using our Services, you acknowledge and agree:

  • Coaching is not a substitute for licensed professional advice or clinical treatment.

  • We do not guarantee specific results or outcomes.

  • You are responsible for your own decisions, actions, and results.
     

If you are experiencing a crisis or mental health emergency, call 911 or contact a licensed professional immediately.

3. Payment, Billing, and Refunds

3.1 Payments

All payments for coaching sessions, programs, or digital products must be made in full at the time of purchase unless otherwise stated in writing.

3.2 Refunds

  • Coaching sessions already delivered are non-refundable.

  • Digital products are non-refundable once accessed, downloaded, or opened unless otherwise required by law.

  • Refund terms for programs or packages will be described at the point of purchase.
     

3.3 Cancellations & Rescheduling
Clients may reschedule a session at least 24 hours in advance.
Late cancellations or missed appointments may be charged at the full rate.

4. Intellectual Property
All content on this Website, including text, graphics, logos, images, videos, course material, worksheets, and any other intellectual property, is owned by Miller Coaching Services or licensed to us.

You may not copy, reproduce, distribute, modify, sell, or create derivative works from any content without our prior written consent.

5. User Responsibilities
By using the Website or Services, you agree not to:

  • Engage in any illegal or harmful activities.

  • Attempt to gain unauthorized access to the Website.

  • Copy or misuse content, materials, or proprietary information.

  • Interfere with the operation or security of the Website.

We reserve the right to terminate access for any user who violates these Terms.

10. Indemnification
You agree to indemnify and hold harmless Miller Coaching Services, its owners, employees, and contractors from any claims, losses, damages, liabilities, including attorney fees, arising out of:

  • Your use of the Website or Services

  • Your violation of these Terms

  • Your violation of any law or rights of a third party
     

11. No Guarantee of Availability
We do not guarantee continuous or error-free operation of the Website. We may suspend or discontinue the Website at any time for maintenance, upgrades, or other reasons.

12. Changes to Terms
We may update these Terms from time to time. When changes occur, the “Effective Date” will be revised. Your continued use of the Website or Services after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles. Any disputes must be resolved in the state or federal courts located in Maryland.

2. Auto-Renewal & Subscription Transparency
If any Services, including programs, memberships, or recurring billing options, are offered on a subscription or auto-renewing basis, Maryland law requires clear and conspicuous disclosure of:

  • The renewal terms

  • The cancellation process

  • The frequency and amount of charges
     

You may cancel a recurring service at any time through the method specified in your order confirmation or by contacting us directly.

3. Maryland Refund Transparency
To comply with Maryland expectations regarding refunds:

  • Prepaid but unused Services follow the refund terms disclosed at purchase.

  • Services already rendered are not refundable unless required by Maryland law.

  • Digital products are non-refundable once accessed, except where Maryland law mandates a remedy (e.g., misleading, defective, or materially inaccurate content).



4. Maryland Electronic Communications Consent
By using the Website, scheduling coaching sessions, or purchasing Services, you consent under Maryland Uniform Electronic Transactions Act (MUETA) to receive:

  • Electronic contracts

  • Notices

  • Receipts

  • Disclosures

  • Customer service communications
     

You may withdraw your consent at any time, but doing so may limit your ability to use certain features of the Website or Services.

5. Maryland Right to Resell, Return, or Cancel Physical Goods
If we offer physical goods (books, journals, printed materials), Maryland consumers will receive:

  • Clear return and refund instructions

  • Condition requirements for return

  • Disclosure of restocking fees (if any)

  • A method for initiating returns

If we do not offer physical goods, this provision does not apply.

6. Maryland-Resident Dispute Resolution Notice
Before initiating any formal legal action, Maryland residents agree to:

  1. Notify us of the dispute in writing.

  2. Allow us up to 30 days to respond and attempt to resolve the issue in good faith.
     

Nothing in these Terms is intended to waive rights guaranteed to Maryland residents under state law.

7. Non-Waiver of Maryland-Specific Rights
If any provision of these Terms conflicts with the rights of consumers under Maryland law, the consumer-protective provision will apply. All other provisions will remain in effect.
